Monsanto Roundup Lawsuit in Bayer’s Court
In the fall of 2016, pharmaceutical and chemical conglomerate, Bayer declared its intention to purchase Monsanto for $66 billion. The sale was finalized on June 7th of 2018, after regulatory approval was achieved from the United States and the European Union. In May of 2019, Bayer paid $80 million in damages for a non-Hodgkin’s lymphoma case (see Hardeman settlement). On the 29th of May, Costco announced that it “would not be selling Roundup this season.”
An Important Roundup Lawsuit Update
On August 9, 2019, Bloomberg reported that Bayer is proposing a settlement of $8 billion to resolve current and future Roundup cases. A figure closer to $10 billion has been discussed, according to plaintiff attorneys and insiders. Following a $30 billion market value drop, Bayer Executive Officer Werner Baumann is ready to consider a ‘financially reasonable’ settlement.
The Road to Roundup Weed Killer Lawsuits
When Monsanto’s ads proclaimed Roundup to be “as safe as table salt,” it compelled New York State’s Attorney General to file a 1996 lawsuit, accusing the company of misleading and false pretexts that glyphosate products were harmless to humans. The case was settled and the offensive statements were removed from sight.
Consumer groups in France sued Monsanto in 2001 for advertising Roundup as a biodegradable pesticide which “left the soil clean,” after use. In 2007 the European Union classified Roundup as “dangerous for the environment, and toxic for aquatic organisms.” Monsanto was convicted and fined 15,000 euros.
The multi-faceted accusations continued around the world, and yet it would take 11 more years for the movement of contention against Monsanto to be taken seriously.
Roundup Cancer Lawsuit Settlements
Lighting a fire under the decades-old movement against Monsanto’s Roundup, the following three major settlements were awarded, erasing $30 billion in market value. They would turn the entire ‘glycophase-is-safe’ debacle upside down and give new hope to those whose suffering had long been ignored or entirely dismissed.
In 2014, a San Francisco school groundskeeper by the name of Dewayne Johnson was diagnosed with non-Hodgkin’s lymphoma after developing an unusual rash. Four years later in 2018, Johnson’s case was taken to California Superior Court by a legal team which included Robert F. Kennedy, Jr. The jury awarded Johnson $289 million, though the amount was lowered to $78 million by the judge. The 3-day deliberation by the jurors resulted in their finding that Monsanto had contributed to Johnson’s non-Hodgkin’s lymphoma by failing to appropriately label Roundup as a potential hazard.
In 2015, Edward Hardeman had already undergone 6 rounds of chemotherapy after being diagnosed on Christmas 2014 with non-Hodgkin’s lymphoma. The Guardian published Hardeman’s recount that, “after seeing a report on television that said exposure to a popular weed killer could lead to exactly the same cancer that was destroying his life,” he filed a Roundup weed killer lawsuit in February of 2019.
Records were introduced into this case which proved that Monsanto had ghostwritten scientific papers used to downplay claims that Roundup was unsafe. Along with negligence for improper labeling, the case produced the first federal court jury verdict which blamed Monsanto for non-Hodgkin’s lymphoma. In May of 2019, Hardeman was awarded over $80 million.
The latest trial, in May of 2019, resulted in a verdict awarding $1 billion each to a senior couple married nearly half a century — later reduced by the judge to a total of $87 million. The Roundup lawsuit plaintiffs were Alva and Alberta Pilliod; Alva’s form of non-Hodgkin’s lymphoma had spread to his bones and spine, while Alberta’s brain cancer was linked to non-Hodgkin’s lymphoma.
